1. Introduction
The scope of these General Terms and Conditions (hereinafter: GTC) covers orders submitted to S-Faber Kft by email, telephone and in person.
According to the Terms and Conditions, any natural or legal person who sends a written order to S-Faber Kft. via any of the communication channels listed above for any product or service offered by S-Faber Kft. is considered a Customer.
This document is published exclusively in electronic form, its validity is for an indefinite period from the date of its date.
S-Faber Kft. reserves the right to modify the conditions set out in these GTC at any time without prior notice to the Customer.

3. Procedure of the order
Requests for proposals are accepted by e-mail, telephone, mail and in person at our offices.
The validity period of the price offers made by S-Faber Kft. is 30 calendar days, the offer binding period other than this is included separately in the offer.
The prices in S-Faber Kft.’s price offers are net prices and do not include VAT. We reserve the right to change prices beyond the validity period of the offer.
In all cases, we accept orders in writing (email, post) and in person at our office. By sending the order, the Customer declares that he has read, understood and accepts the provisions of these GTC.
The order is considered valid if it has been confirmed in writing within 2 working days, which confirmation contains the items of the order, as well as the previously negotiated final performance, delivery and payment conditions.
The confirmed order is binding for both parties.
S-Faber Kft. assumes no responsibility for any technical or other errors occurring in the Internet connection, mail system, or any data traffic and the resulting consequences. If you do not receive a confirmation within 2 working days, please make an appointment by phone to clarify the error.
4. Performance
In all cases, the place of performance is determined based on the agreement between S-Faber Kft. and the Customer. The prices given in the quotation refer to the collection of the product at the site.
Place of collection: 6000 Kecskemét, Wéber Ede u. 35.
Time: on working days between 6:00 a.m. and 2:00 p.m.
In the case of acceptance at the premises of S-Faber Kft., it is the Customer’s responsibility to provide a transport vehicle of the appropriate size, and S-Faber Kft. cannot be held responsible for failure to deliver.
At the Customer’s request, we will deliver the goods to the requested location, the exact cost of which will be informed to the Customer at the time of delivery. In the case of delivery to the delivery address indicated by the Customer, the Customer will take care of the unloading himself.
Quality and quantity acceptance takes place at the place of delivery. The Customer verifies the performance by signing and stamping the delivery document (delivery note or CMR), or, in the absence thereof, with the identity card number or registration number.
Upon receipt of the goods, the customer must indicate his objections to quantity and quality immediately, otherwise, until the justification of the objection is proven, it must be assumed that S-Faber Kft. performed in accordance with the order, in perfect quality and quantity. A record of detected deficiencies must be recorded at the place of receipt.
Objections that cannot be revealed upon receipt must be reported to the Customer in writing immediately, but no later than one week after receipt, together with documents and photographs proving the objection.
If the objection is justified, the defect must be rectified by mutual agreement in all cases, giving S-Faber Kft. the opportunity to eliminate the defect at its own discretion.
S-Faber Kft. assumes responsibility for the quality of the product if it is used as intended and if it is regularly maintained. In other cases, S-Faber Kft. is not responsible for product failure.
5. Payment methods:
The Buyer settles the purchase price of the products by bank transfer until the payment deadline indicated on the invoice. S-Faber Kft. retains ownership of the goods until the invoice is paid in full.
The Customer undertakes to strictly comply with the pre-arranged payment deadline indicated on the invoice. In case of delayed payment, the Customer is obliged to pay interest on late payment and flat-rate collection costs according to the Civil Code.
S-Faber Kft. reserves the right to request full or partial payment of the purchase price from the Customer in certain cases before the order is fulfilled. You have 8 days to pay the Fee Requester, after 8 days the stockpile reservation will be cancelled. We separate the paid goods for the Customer in our warehouse, which the Customer is obliged to deliver within 1 week. In the event of a delay in acceptance, S-Faber Kft. is obliged to keep the goods according to the rules of handling without an order, and the risk of damage is transferred to the Customer.
6. Withdrawal from the contract, return of the goods
The confirmed order creates a binding contract for both parties.
Termination of the contract by both parties can only be done in writing for a valid reason.
According to the legal regulations in force, in the case of legal persons (enterprises), they are not obliged to take back the goods in the event of subsequent withdrawal from flawlessly completed orders or from transactions settled financially with advance payment.
7. Legal dispute
The provisions of the Civil Code shall govern matters not regulated in these General Terms and Conditions.
The current rules of the Vienna Convention on Contracts for the International Sale of Goods (CISG) and Incoterms apply to international transactions.
For the adjudication of any dispute arising out of or in connection with this contract, especially in relation to its breach, termination, validity or interpretation, the parties exclude the state court and submit to the exclusive jurisdiction of the Permanent Arbitration Court (Kereskedelmi Válastottbíróság Budapest) operating under the Hungarian Chamber of Commerce and Industry and its final decision with the fact that the Arbitration Court acts according to its own Rules of Procedure (supplemented with the provisions of the Sub-Regulations on Expedited Procedure), the number of acting arbitrators is three and the Hungarian language must be used during the proceedings. The parties exclude the possibility of renewing the procedure regulated in Chapter IX of Act LX of 2017 on arbitration.
8. Data protection
S-Faber Kft. complies with the data protection regulations of the GDPR. We treat the data of partners registered in the administration system, the website and the newsletter system as confidential, we use the data only for maintaining contact, we do not allow access to third parties.
